Terms and Conditions for Fixiigo

Welcome to Fixiigo ("Platform", "App", "We", "Us", or "Our"). These Terms and Conditions ("Terms") govern your access to and use of the Fixiigo mobile application, services, websites, and content.

By downloading, installing, registering, or using the Fixiigo application, you ("User", "Worker", "Property Owner", "Buyer", "Tenant", or "You") agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must immediately cease all use of the platform.

1. Description of Service & Platform Intermediary Status

1. Marketplace Intermediary Only: Fixiigo is strictly an online venue and software platform designed to facilitate contact between independent third-party service workers, property owners/sellers/landlords, and users seeking service or property options.

2. No Employment Relationship: Fixiigo does not employ, contract, manage, supervise, direct, or control any service worker, technician, contractor, or handyman listed on the platform. Service workers operate as independent entities.

3. No Real Estate Agency: Fixiigo is not a registered real estate broker, landlord, property manager, title verification service, or legal escrow agent.

2. Complete Disclaimer of Liability: Worker Misbehavior & Conduct

1. Independent Worker Liability: Any worker hired or contacted through the platform is an independent contractor. Fixiigo assumes NO RESPONSIBILITY OR LIABILITY for any worker's behavior, misbehavior, misconduct, illegal acts, verbal abuse, physical assault, harassment, theft, fraud, negligence, property damage, accidents, bodily injury, or unsatisfactory work performance.

2. User Due Diligence: Users are solely responsible for evaluating, vetting, verifying, and taking safety precautions before allowing any worker onto their premises or transferring any direct payments to workers.

3. Direct Worker-User Disputes: Any disputes, claims, demands, or legal causes of action arising between a user and a worker must be settled directly between the involved parties. Fixiigo will not participate in, mediate, or accept liability for any such dispute.

3. Complete Disclaimer of Liability: Property Listings, Fraud & Fake Documents

1. User-Generated Property Listings: Property listings, pricing details, specifications, location points, photos, ownership claims, and documentation details are provided entirely by independent users, property owners, or real estate listings providers.

2. No Verification of Documents or Ownership: Fixiigo does NOT verify property title deeds, government registration documents, encumbrance certificates, physical property conditions, survey boundaries, or legal ownership claims.

3. Zero Liability for Property Fraud: Fixiigo is NOT RESPONSIBLE OR LIABLE for any false property listings, fake documents, owner/agent fraud, deceptive pricing, duplicate listings, illegal property sales/rentals, or financial losses incurred by buyers, sellers, or tenants.

4. Mandatory Due Diligence: You explicitly acknowledge that you must independently perform full legal verification, document title checks, structural inspections, and physical visits before making any agreement, advance deposit, rental payment, or property purchase.

4. User-Uploaded Content, Images & Photo Compression

1. Uploaded Media Responsibility: Users uploading photos or text (including profile pictures, service request photos, and property listing images) warrant that they own all rights to the media or have explicit permission to post it.

2. Prohibited Content: Users are strictly prohibited from uploading fraudulent, copyrighted, defamatory, obscene, illegal, or unauthorized media.

3. Image Compression: Fixiigo automatically compresses uploaded images (down to 300 KB or less) for system performance optimization. Fixiigo is not liable for minor image quality variations resulting from automated compression algorithms.

4. Platform Immunity: Fixiigo accepts no liability for unauthorized or illegal content uploaded by users and reserves the right to remove any listing or content without prior notice.

5. Coin Purchases, Subscription Plans & Strict No-Refund Policy

1. In-App Purchases: Fixiigo offers virtual coin packages, subscription plans, contact unlock features, and listing promotion tools.

2. Strict No-Refund Policy: ALL PAYMENTS, COIN PURCHASES, SUBSCRIPTIONS, AND UNLOCK FEES MADE ON FIXIIGO ARE 100% FINAL, NON-CANCELABLE, AND NON-REFUNDABLE UNDER ANY CIRCUMSTANCES.

3. No Guarantees: Fixiigo makes no guarantee that purchasing coins, subscribing to a plan, or unlocking a contact number will result in a completed job, successful property transaction, agreement, or response from a worker/owner. No refunds will be provided for unfulfilled external transactions or unresponsive third parties.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIXIIGO, ITS OWNERS, DEVELOPERS, FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

- LOSS OF MONEY, PROFITS, REVENUE, DATA, OR GOODWILL;

- PHYSICAL INJURY, PROPERTY DAMAGE, THEFT, OR PERSONAL ABUSE BY WORKERS;

- FINANCIAL LOSSES RESULTING FROM FRAUDULENT PROPERTY LISTINGS OR FAKE PROPERTY DOCUMENTS;

- ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR PERSONAL INFORMATION STORED THEREIN;

- SERVICE INTERRUPTIONS, APP BUGS, ERRORS, OR INACCURACIES IN APP CONTENT.

7. Indemnification & Hold Harmless

You agree to defend, indemnify, and hold harmless Fixiigo, its parent company, operators, developers, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including attorney's fees) arising from:

1. Your use of and access to the Fixiigo mobile application;

2. Your violation of any term of these Terms and Conditions;

3. Any worker misbehavior, property damage, dispute, or agreement between you and any third-party worker or property owner;

4. Any fraudulent property listing, fake document, or unauthorized content uploaded under your account.

8. Account Termination & Suspension

Fixiigo reserves the right, in its sole discretion and without prior notice or liability, to suspend or terminate any user account, block device access, or remove listings if a user violates these Terms, engages in fraud, misbehaves, or posts unauthorized content. Users may also voluntarily request account deletion at any time via Settings > Delete Account in the mobile app.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal dispute, claim, or controversy arising out of or in connection with these Terms or the Fixiigo application shall be subject to the exclusive jurisdiction of the competent courts in India.
